Ofirio, Inc. (referred to herein as “Ofirio”, “we”, “our”, or “us”) and its affiliates, recognizes the importance of protecting the Personal Information we may collect from visitors, users and any other individual or entity (“Users”, “you”, or “your”). This Privacy Policy applies to data collection and privacy practices of Ofirio and when we collect Personal Information through your use of the website, https://ofirio.com/, and other Ofirio-related sites, software and applications accessible on or by any top-level Ofirio domain owned by us (each, a “Site” and collectively the “Sites”), through our social media pages that we control, and through email messages that we may send to you (collectively, the “Services”).

This Privacy Policy describes how we use Personal Information, with whom we share it, your rights and choices, and how you can contact us about our privacy practices. This policy does not apply to third-party websites, products, or services, even if they link to our Services or Sites, and you should consider the privacy practices of those third-parties carefully. Please familiarize yourself with our privacy practices and let us know if you have any questions. By using the Sites, you signify your acceptance of this Privacy Policy. Like other websites and apps, we collect data about the browsers and devices you use to access Ofirio. The data we collect includes browser or device model and settings, operating system, unique identifiers, and the version of the app you’re using. We also collect data about how your browsers and devices interact with our services, including IP address, crash reports, system activity, and the date, time, and the URL of the site you visited before Ofirio. You can control our collection of certain data, such as your mobile device model or the language your mobile device uses, by adjusting the privacy and security settings on your mobile device.

If you enable location services on your mobile device, Ofirio collects the location of your device. We use that information to provide you with location-based information and ads, like homes and real estate professionals in your area, and to offer location-based services. If you don’t want to use these features, you can turn off location services on your device. We also collect location information for similar purposes from your browser if you enable it. You can disable access through your browser settings.

When Ofirio needs to share data to satisfy a legal or regulatory requirement, including responding to a subpoena or other lawful government request for data, we will share information only as necessary to comply with that requirement. We may also share information if needed to enforce our legal rights, detect or prevent fraud or security concerns, and protect public safety.

If Ofirio is involved in a merger, acquisition, or any form of transfer or sale of some or all of its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, we may share your information in connection with that transaction.

Ofirio allows certain companies to place tracking technologies like cookies and pixels on our sites, which allow those companies to receive information about your activity on Ofirio that is associated with your browser or device. The companies may use that data to serve you more relevant ads on our sites or others. Under some state laws, sharing data for online advertising like this may be considered a “sale” of information. Except for this kind of sharing, Ofirio doesn’t sell any of your information.

In this section, we’ve provided some legally required disclosures under state privacy laws. There shouldn’t be anything surprising in this section, and we’ve tried to explain our privacy practices in plain English throughout the rest of the policy.

Under the California Consumer Privacy Act or CCPA, California residents have certain rights regarding their data, including:

California residents also have the right to not be discriminated against if they choose to exercise their privacy rights.

Our Privacy Policy applies to all of the Services offered by Ofirio, including its affiliates, to Users. Our Privacy Policy is intended to describe our data collection practices and applies unless there is a specific country privacy policy which applies to you. However, because the data protection and privacy laws in some jurisdictions where our Services are located may restrict our data collection and processing practices, our practices may be more restrictive subject to local laws. Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you, or other sites linked from our Sites or Services. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our Services, and who may use cookies, pixel tags and other technologies to serve and offer relevant ads.

By accessing or using the Sites in any manner, you also agree to be bound by Ofirio’s Terms of Use (the “Agreement”). Please read the Agreement carefully. If you do not accept all of the terms and conditions contained in or incorporated by reference into the Agreement, please do not use the Sites.

Ofirio uses and discloses your personal information as follows:

• to third-party organizations that provide services to Ofirio to fulfill your request (e.g. to process your buy or sell transaction) and are bound by these same privacy restrictions;
• contact you via email in the future to tell you about specials, new service offerings, or changes to this privacy policy;
• to analyze site usage and improve the Service;
• to deliver to you any administrative notices, alerts and communications relevant to your use of the Service;
• to manage our business and protect ourselves, you, other persons, and the Services;
• to provide a personalized experience and implement your preferences;
• to fulfill your requests for certain services and transactions;
• for market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;
• to enforce Ofirio’s Terms of Use; and
• as otherwise set forth in this Privacy Policy.

In the event that you access the Service as brought to you by our partners or service providers, through a co-branded URL or by web services, your email address used for registration on the Service may be provided to that partner or service provider to fulfill your request.

We do share real estate and multiple listing data on a subscription basis to our customers. We may share this information for financial consideration to real estate agents, brokers, mortgage companies and similar third parties.

We and our service providers may use IP addresses to understand the locations from which our Users and visitors are accessing the Services. Except where prohibited by applicable law or regulation, we may combine information collected through one source with information obtained through other resources. We also may supplement the information we collect with information obtained from third parties. We will treat any information that we combine with your personal information as Personal Information pursuant to this Privacy & Security Policy.

Certain areas and features of Ofirio.com are available to you without registration or the need to provide to us any information. However, other features of the Site or the Service may require registration, which involves provision to Ofirio of an email address, a password and additional details for fulfilling your service requests and to participate on our third party sites, a username (collectively the “Registration or Sign Up Information”). In order to benefit from the full functionality of the Service, you may also be asked to provide additional information to all Ofirio to share more data for your use.

From time to time we may request other personal information to provide you with other benefits of the Service such as application for a loan or payment instructions for purchasing a property. In all such instances, you will be given the opportunity to provide or to decline to provide that information, and it will be used only for the stated purpose. By providing the information, you are also agreeing to share the information with other Service providers such as Property Provider, lender, insurance company, Title company, Escrow/ Closing Attorney, inspection company, appraisal company and others for fulfilling your buy/ sell/ manage service requests. We may collect credit or debit card information in order to process payments but all payment processing will be handled by a third party payment processor.

Ofirio may make anonymous or aggregate personal information and disclose such data only in a non-personally identifiable manner to:

• Advertisers and other third parties for marketing and promotional purposes, such as the number of users who applied for a loan or how many users clicked on a particular Offer from Ofirio;
• Organizations approved by Ofirio that conduct research into investment purchases; and
• Users of the Service for purposes of comparison of their personal financial situation relative to the broader market.

Such information does not identify you individually. Access to your Registration Information, other Credentials, and any other personal information you provide is strictly restricted and used in accordance with specific internal procedures and safeguard governing access, in order to operate, develop or improve the Service. These individuals have been selected in accordance with our security policies and practices and are bound by confidentiality obligations. We may also use third party vendors or service providers to help us provide the Service to you, such as sending e-mail messages on our behalf or hosting and operating a particular feature or functionality of the Service or a lender processing your loan application. Our contracts with these third parties outline the appropriate use and handling of your information and prohibit them from using any of your personal information for purposes unrelated to the product or service they are providing. We require such third parties to maintain the confidentiality of the information we provide to them.

If your Registration Information changes during your subscription to Ofirio, you may update it any time via the Service.

You agree that we may contact you by telephone (including cell phones), facsimile, email or other internet facilities. The contact may be made by a live human or an automated system. These phone calls can address a wide variety of issues including, but not limited too, sales, offerings, and client contact. Calls may be pre-recorded and calls or texts may be made via automated dialing system. Voice and data rates may apply at your own expense. You can opt out by giving us notice at [email protected]

When you visit Ofirio.com, we may collect technical and navigational information, such as computer browser type, Internet protocol address, pages visited, and average time spent on our Site. This information may be used, for example, to alert you to software compatibility issues, or it may be analyzed to improve our Web design and functionality.

“Cookies” are alphanumeric identifiers in the form of text files that are inserted and stored by your Web browser on your computer’s hard drive. Ofirio may set and access cookies on your computer to track and store preferential information about you. Ofirio may gather information about you through cookie technology. For example, Ofirio may assign a cookie to you, to limit the amount of times you see a particular Ofirio Offer or to help better determine which Ofirio Offers to serve to you. Please note that most Internet browsers will allow you to stop cookies from being stored on your computer or device and to delete cookies stored on your computer or device. If you choose to eliminate cookies, the full functionality of the Service may be impaired for you.

Web beacons or zero or single byte tags are embedded in a Web page or email for the purpose of measuring and analyzing site usage and activity. Ofirio, or third party service providers acting on our behalf, may use Web beacons to help us analyze Site usage and improve the Service.

We may use third party service providers to help us analyze certain online activities. For example, these service providers may help us measure the performance of our online and email campaigns or analyze visitor activity on Ofirio.com and related sites. We may permit these service providers to use cookies and other technologies to perform these services for Ofirio. We do not share any personal information about our customers with these third party service providers, and these service providers do not collect such information on our behalf. Our third party service providers are required to comply fully with this Privacy Policy.

There are a number of separate products and services offered by third parties advertised by us on our Site and through the Service that may be complementary to your use of Ofirio.com, such as lenders, investment companies, retirement services providers, and brokerage institutions (collectively, “Ofirio Offers”). If you choose to use these separate products or services, disclose information to the providers, or grant them permission to collect information about you, then their use of your information is governed by their privacy policies. You should evaluate the practices of external services providers before deciding to use their services. Ofirio is not responsible for their privacy practices. If you click on a link to a third party site, Ofirio encourages you to check the privacy policy of that site. Ofirio may present links in a format that enables us to keep track of whether these links have been followed and whether any action has been taken on a third party Web site. We use this information to improve the quality of the Ofirio Offers and customized content on the Service. Our inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators. Further, it is up to the User to take precautions to ensure that whatever links the User selects or software the User downloads (whether from this Site or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. If you have any questions about the privacy practices of other websites, you should contact the relevant parties controlling these websites for more information.

If you use a social media, bulletin board, blog or chat room from our Site, you should be aware that any information you submit there can be read, collected or used by other users and could be used to send you unsolicited messages. We are not responsible for the personal information you choose to submit in these online media. These media may be hosted by Ofirio or by a third party service providers.

From time to time, Ofirio may offer you the opportunity to participate in contests, giveaways and other promotions. Any information submitted in connection with such activities will be treated in accordance with this Privacy Policy, except as specifically set forth in the rules for those contests, giveaways or promotions. From time to time, Ofirio may also ask you to participate in surveys and feedback designed to help Ofirio improve the Site. Any personal information provided to Ofirio in connection with any survey will be used only in relation to that survey and as elsewhere set forth in this Policy.

For protecting the privacy of young children, Ofirio does not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, do not share any information about yourself to us, including your name, address, telephone number, or email address. No one under age 18 is allowed to provide any personal information to Ofirio. In the event that we learn that we have collected personal information from a child under age 18 without verification of parental consent, we will delete that information as quickly as possible. If a child has provided us with Personal Information, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under age 18 in the applicable jurisdiction, please contact us [email protected]. As a parent you are responsible for any transactions or services requested from Ofirio.

Notwithstanding the foregoing, Ofirio reserves the right (and you authorize Ofirio) to share or disclose your personal information when Ofirio determines, in its sole discretion, that the disclosure of such information is necessary or appropriate:

• To enforce our rights against you or in connection with a breach by you of this Privacy Policy or the Ofirio.com Terms of Use;
• To prevent prohibited or illegal transaction or activities;
• Protect against harm to the rights, property, assets or safety of Ofirio, our users or the public, content found on the Services, or to protect the Services from unauthorized use or misuse, as required or permitted by law;
• When required by any applicable law, rule regulation, subpoena or other legal process.

We attempt to notify you about legal demands for your Personal Information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

Personal information may be transferred to a third party as a result of a sale, acquisition, merger, reorganization or other change of control. If we sell, merge or transfer any part of our business, part of the sale may include your personal information. If so, you will be asked if you’d like to stop receiving promotional information following any change of control.

Your data is yours. You can request us to remove it anytime you want. When you request us to delete your account for the Service, your data will be permanently expunged from our primary production servers and further access to your account will not be possible. We will also promptly disconnect any connection we had established to your Account Information and delete all related credentials. However, portions of your data, consisting of aggregate data derived from your Account Information, may remain on our production servers indefinitely. Your data may also remain on a backup server or media. Ofirio keeps these backups to ensure our continued ability to provide the Service to you in the event of malfunction or damage to our primary production servers. We also reserve the right to use any aggregated or anonymous data derived from or incorporating your personal information.

We provide our registered customers with periodic newsletters, summaries of their property portfolios and email alerts. We also allow users to subscribe to email newsletters and from time to time may transmit emails promoting Ofirio or third-party goods or services. Ofirio.com subscribers can opt-out of receiving our promotional emails and to terminate their subscriptions by following the instructions in the emails. Opting out in this manner will not end transmission of service-related emails, such as email alerts.

Ofirio maintains administrative, technical and physical safeguards designed to protect the user's Personal Information and other information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We use a combination of firewall barriers, encryption techniques and authentication procedures, among others, to maintain the security of your online session and to protect Ofirio.com accounts and systems from unauthorized access.

When you register for the Service, Ofirio requires a password from you for your privacy and security. Ofirio transmits your buy/ sell/ manage transaction data securely.

Our databases are protected from general employee access both physically and logically. We encrypt your Service password so that your password cannot be recovered, even by us. All backup data are also encrypted.

We enforce physical access controls to our buildings.

Although we take reasonable steps designed to protect your Personal Information, please be advised that no security system or means of transmitting data over the Internet can be guaranteed to be entirely secure (including without limitation with respect to computer viruses, malicious software and hacker attacks). We cannot and do not guarantee or warrant the security of your Personal Information or any information you disclose or transmit to us. We are not responsible for the acts of those who gain unauthorized access, and we make no warranty, express, implied or otherwise, that we will prevent such access, and we are not responsible for any damages or liabilities relating to any such incidents to the fullest extent permitted by law. Where required under law, we will notify you of any such loss, misuse or alteration of Personal Information that may affect you so that you can take the appropriate actions.

However, it is important to understand that these precautions apply only to our Site and systems. We exercise no control over how your information is stored, maintained or displayed by third parties or on third-party sites.

We maintain strict rules to help prevent others from guessing your password. We also recommend that you change your password periodically. Your password must be 6-8 characters in length. You are responsible for maintaining the security of your Login ID and Password. You may not provide these credentials to any third party. If you believe that they have been stolen or been made known to others, you must contact us immediately. In any event you should change your password immediately via the Service. We are not responsible if someone else accesses your account through Registration Information they have obtained from you or through a violation by you of this Privacy Policy or the Ofirio.com Terms of Use.

If you are forwarding any links related to data or otherwise provided by Ofirio, you are doing so at your own risk. Ofirio cannot be held liable for any consequences of such sharing.

We update this Privacy & Security Policy periodically. We will not reduce your rights under this Privacy & Security Policy without your explicit consent. We will post any changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services or programs, email notification or Privacy Policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review. The date last revised appears at the top of the Policy. Changes take effect immediately upon posting.

The Personal Information we collect is stored and/or processed where we or our partners, affiliates, and third-party providers maintain facilities. Please be aware that the locations to which we store, process, or transfer your Personal Information may not have the same data protection laws as the country in which you initially provided the information. If we transfer your Personal Information to third parties in other countries: (i) we will perform those transfers in accordance with the requirements of applicable law; and (ii) we will protect the transferred Personal Information in accordance with this privacy policy.
